Today, it's about the radical judges who are giving Trump and the MAGA movement a hard time. OpEd: THE BIAS OF NEVER-TRUMP JUDGES

We're in the thick of a judicial crisis, and it's very anti-Trump. 

In the first few weeks of Trump’s amazing presidency, we've seen federal judges, one after another, blocking his initiatives. This isn't just about checks and balances; it's about a select few with lifetime appointments deciding they know better than the 75 million of us who voted for change.

Let's start with Judge John C. Coughenour — a guy who was appointed by the one-term disaster, George H.W. Bush. This should-be-retired-84-year-old-judge blocked Trump's recent executive order on birthright citizenship. I’m not shocked considering the entire Bush family consists of Republicans in name only; birds of a feather flock together.

Never forget that the other Bush disaster, George W., wouldn't even endorse Trump in the 2024 election, showing where the Bush loyalties lie. And then we have his brother, Jeb, the former governor of Florida who got wiped off the political map by Trump in 2016, famously described illegal immigration as an "act of love" — a stance that's far from your and my demands to secure the borders.

Coughenour's decision against Trump isn't just a legal ruling; it's a continuation of his RINO politics. Case in point: You may recall Coughenour’s leniency with the "Millennium Bomber," Ahmed Ressam. He was the radical Islamic Algerian national who received extensive training in Afghanistan at camps associated with al-Qaeda. Coughenour shocked the country when sentencing Ressam to a mere 22 years for plotting to blow up California’s LAX airport in 1999. The sentencing was so shocking that the far-left Ninth Circuit Court of Appeals had to intervene, increasing it to 37 years.

Then there's Judge Carl Nichols, a Trump appointee. Yes, even Trump made some really bad hires due to inexperience in his first term, and Nichols appears to be one of them. Days ago, he blocked Trump's effort to place USAID employees on administrative leave. Why Nichols championed for more D.C. corruption instead of protecting American taxpayers must be questioned.

The other judges, Deborah Boardman, George O'Toole Jr., Emmet G. Sullivan, and Paul A. Engelmayer, all Democratic appointees, have similarly intervened. They've blocked efforts to streamline government, enforce immigration laws, and secure our nation's sovereignty. Each decision seems less about legal precedent and more about advancing a far-left agenda that's hostile to the very principles that make America great.

Let’s take a look at them in detail:

Judge Deborah Boardman - Appointed by Joe Biden:

  • She issued a nationwide injunction against Trump's birthright citizenship plan, arguing it was unconstitutional. This ruling not only misinterprets the 14th Amendment, but it flies in the face of securing our borders, essentially endorsing the Democrat’s bogus notion that a baby birthed by an illegal alien mother in the U.S. should be automatically granted citizenship.

  • Boardman has a history of supporting expansive interpretations of voting rights, which many people say has led to less secure elections, promoting policies like mail-in voting without sufficient checks, which we know can be rife with fraud.

Judge George O'Toole Jr. - Appointed by Bill Clinton:

  • O'Toole halted Trump's "Fork in the Road" federal employee buyout offer, a program aimed at reducing government bloat. His decision seems more about protecting the deep state than about fiscal responsibility or serving the taxpayer.

  • He's made past rulings that favor radical environmental regulations over economic growth, supporting crazy EPA rules that kill industry and job creation.

Judge Emmet G. Sullivan - Appointed by Bill Clinton:

  • Sullivan granted a temporary restraining order against Trump's decision to terminate USAID employees, which was about making government more efficient. His decision seems driven by a desire to maintain the status quo of big government rather than supporting necessary reforms.

  • Sullivan is infamous for his handling of the Ted Stevens case, where he appointed an independent counsel to investigate prosecutorial misconduct, which some saw as overstepping judicial bounds.

  • He also ruled against Trump’s use of Title 42 during the Covid era. The policy was inserted by Trump as a way to prevent potentially sick illegal aliens from entering the U.S. by means of pawning themselves off as “asylum seekers.” Sullivan clearly prioritized open borders over public health and safety.

  • Judge Emmet G. Sullivan's decision to unseal documents from the Mueller investigation was seen by Trump supporters as a blatant attempt to keep the bogus Russia collusion narrative alive, undermining Trump's presidency with politically motivated judicial activism.

Judge Paul A. Engelmayer - Appointed by Barack Obama:

  • Early in the morning on February 8, 2025, Engelmayer restricted access by Trump's Department of Government Efficiency to the Treasury's payment and data systems, citing "irreparable harm." This move is more about obstructing government reform than protecting against any real harm.

  • He's known for decisions that lean heavily towards civil rights, like rulings supporting broad interpretations of the Voting Rights Act, which is often at odds with state sovereignty or local control over elections.

These judges, and others like them, with their lifetime appointments, operate without real accountability. They can rule based on their biases or political leanings, knowing they'll never face the electorate or lose their positions. This lifetime tenure was meant to ensure judicial independence, but in practice, it's allowed for judicial overreach and the ability for judges to get drunk on their own power.

Let's not forget about these classics:

  • Judge Wade McCree - Appointed by the then Democrat Governor of Michigan, Jennifer Granholm, McCree engaged in a sexual relationship with Geniene La'Shay Mott while presiding over her child support case, leading to his suspension and a subsequent investigation that ended with McCree's removal from the bench.

  • Judge Michael Maggio - know for his liberal rulings, was caught red-handed trading judicial favors for dirty campaign cash, directly aiding a nursing home owner in slashing a hefty negligence lawsuit payout by millions of dollars. His blatant corruption led to his permanent removal from the bench and a 10-year prison sentence.

  • Judge Tim Wright (Alabama Circuit Judge) - While not a federal judge, Wright, known for liberal-leaning decisions, was accused of election interference in 2008. He was involved in a case where he ordered the Alabama Secretary of State to accept late-voter registrations from a community group, ACORN, despite state law deadlines.

These cases are stark reminders that without proper checks, the judiciary can become just another branch of government ripe for abuse.

But what's behind these judicial decisions in 2025? 

It’s not just corruption; it’s ideology. These radical judges are not just misinterpreting the law; they're reshaping it to fit a narrative that's at odds with constitutional principles. They stand for policies that defy common sense - like blocking border security measures in the name of "compassion," or halting executive actions meant to reduce government waste, under the guise of protecting "worker rights." These rulings drive a stake into the heart of the Constitution, prioritizing progressive politics over legal duty.

The solution? Reform.

Trump knows better than anyone how the courts can bully through biased and unfair rulings without any price to pay. Thus, he needs to explain to America that we need a massive change. We need judges to be elected, not appointed.

Judges should answer to the people. Elections mean accountability. Meaning, if a judge steps out of line, they can be voted out. But even elected judges can cling to power too long, which brings us to the second point - term limits. Just like with any other public office, judges should serve set terms, perhaps 8 years, then step aside for fresh perspectives.

Imagine if these judges had to face voters or knew their time was limited. Would they dare to legislate from the bench? Would they push through rulings that clearly serve an ideological agenda over the law? I doubt it.

Elected judges with term limits would realign the judiciary with the will of the American people, not the elite or the echo chambers of academia and media. They would be forced to consider the Constitution above all else, rather than bending it to fit contemporary political winds.

In 2025, as we watch these judges overstep, it's clear that Elon Musk and DOGE should put the judicial system on the audit list. We need a judiciary that reflects the American spirit, not the agendas of the D.C. elite who've lost touch with the average citizen.

So, considering we voted for change, I hope Trump and Musk not only read this Op-Ed, but decide to move forward with my suggestions. I hope you will share it to your contacts via email. America deserves better, and we are smarter. America must demand we have a judiciary that upholds the law, not personal or political agendas. It's time to make our judicial system great again - accountable, transparent, and truly representative of the American people.
